SwitchKart Technologies Private Limited (“SwitchKart”, “we”, “us”, “our”) respects your privacy and is committed to protecting the personal data you share with us through www.switchkart.com and the SwitchKart mobile application (together, the “Platform”). This Privacy Policy explains what personal data we collect, how we use it, who we share it with, and the rights available to you under applicable Indian law, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Information Technology Act, 2000 along with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
2. Personal Data We Collect
We may collect the following categories of personal data when you use the Platform:
2.1 Identity and Contact Data
- Full name
- Mobile number
- Email address
- Pickup address and, where relevant, precise geolocation for scheduling
2.2 Transaction and Device Data
- Device brand, model, variant, age, and self-declared condition
- IMEI / serial number
- Photographs of the Device submitted by you
- Quotation, valuation, and final sale price history
2.3 Payment Data
- UPI ID or bank account details (account number, IFSC) required to process payout to you
- Transaction reference and payment status (SwitchKart does not store your UPI PIN or full bank credentials; payments are processed through regulated payment gateway/banking partners)
2.4 Verification / KYC Data
- Government-issued identity proof, where required for high-value transactions or as mandated by applicable law or SwitchKart's anti-fraud policies
2.5 Usage and Technical Data
- IP address, device identifiers, browser type, and operating system
- Pages visited, time spent, and interactions on the Platform
- Cookies and similar tracking technologies (see our Cookie Policy)
2.6 Communications Data
- Records of your communications with SwitchKart customer support, including via phone, email, or WhatsApp
3. How We Collect Your Data
- Directly from you, when you request a quotation, register, schedule a pickup, or contact customer support;
- Automatically, through cookies, analytics tools, and similar technologies as you browse the Platform;
- From our pickup and vendor partners, who record inspection results and verification outcomes at the time of pickup;
- From third parties such as payment gateways and banking partners, to confirm successful payment processing.
4. Purposes for Which We Use Your Data
We process your personal data for the following purposes, consistent with the notice provided to you at the point of collection:
SwitchKart may retain records of your transaction (including device, pricing, and quotation history) as part of its business records for analytics, pricing model improvement, audit, and legitimate business purposes, in accordance with applicable data retention and DPDP Act requirements. Such records are maintained securely and are not made public.
5. Legal Basis and Consent
We process your personal data on the basis of your consent, provided at the time you use the Platform, and, where applicable, for the performance of the transaction you have requested, compliance with a legal obligation, or SwitchKart's legitimate business interests, in a manner consistent with the DPDP Act. You may withdraw your consent at any time as described in Section 9 (Your Rights) below, though this may affect our ability to complete a transaction already in progress.
6. How We Share Your Data
We may share your personal data with:
- Pickup and vendor partners — to enable Device pickup, inspection, and payment at your location;
- Payment processing and banking partners — to complete payout to you;
- Service providers — such as cloud hosting, analytics, customer support, and SMS/WhatsApp communication providers, who process data on our behalf under contractual confidentiality obligations;
- Law enforcement and regulatory authorities — where required by law, including in connection with suspected stolen or blacklisted devices, or in response to a valid legal request;
- Professional advisors and auditors — on a confidential basis, where necessary; and
- Successors — in connection with a merger, acquisition, or sale of business assets, subject to equivalent privacy protections.
7. Data Retention
We retain your personal data for as long as necessary to fulfil the purposes described in this Policy, including to complete your transaction, comply with applicable legal, tax, and audit requirements, resolve disputes, and enforce our agreements. Retention periods may vary based on the type of data and applicable regulatory requirements. Where data is no longer required, we take reasonable steps to securely delete or anonymize it.
8. Data Security
We implement reasonable security practices and procedures, including encryption, access controls, and secure storage, in line with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to protect your personal data against unauthorised access, alteration, disclosure, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your Rights
Subject to applicable law, including the DPDP Act, you have the right to:
Access
A summary of the personal data we hold about you and the processing activities undertaken;
Correction & Updating
Correction and updating of inaccurate or incomplete personal data;
Erasure
Erasure of your personal data, where it is no longer necessary for the purpose for which it was collected, subject to our legal retention obligations;
Withdraw Consent
Withdraw Consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal;
Grievance Redressal
By contacting our Grievance Officer as set out in Section 12 below; and
Nominate
Nominate another individual to exercise these rights on your behalf in the event of your death or incapacity, as permitted under the DPDP Act.

10. Cookies
The Platform uses cookies and similar tracking technologies. Please refer to our Cookie Policy for details on the types of cookies used and how you can manage your preferences.
11. Children's Privacy
The Platform is not directed at, and we do not knowingly collect personal data from, individuals under the age of 18. If we become aware that we have inadvertently collected personal data from a minor, we will take steps to delete such data promptly.

In accordance with the Information Technology Act, 2000, the rules made thereunder, and the DPDP Act, the details of our Grievance Officer are as follows:

13. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. The updated version will be posted on the Platform with a revised “Effective Date”. We encourage you to review this Policy periodically.
